#1424: - Re: Re: Hi Tony

WHAT YOU ARE DOING BY NOT ENJOYING THE COMMON AS OF RIGHT,IS DENYING YOUR ANIMAL-S THEIR RIGHTS TO ENJOYABLE EXERCISE AND QUALITY TIME WITH YOU.

THE CATTLE HAVE NO RIGHTS TO BE ON THE COMMON, THIS IS PROVIDED FOR IN THE REGISTRATION OF RIGHTS BELONGING TO COMMONERS AS TO WHICH RIGHTS THEY HAVE, COMMONERS ON YOUR COMMON ONLY HAVE TO THE SOIL, SAND-GRAVEL-STONE.

WCC HAVE NO, RIGHTS WHATSOEVER,THE FARMER HAS NO RIGHTS, DOGS WORRYING LIVESTOCK ARE APT TO GET SHOT, OR THE OWNER MAY HAVE A COURT ORDER LAID AGAINST THEM, THE CATTLE ARE, IN LEGAL TERMS  TRESSPASSER'S, AND IN THE SAME TERMS SHOULD THE CATTLE BECOME A NUSIANCE THEN THE OWNER MAY HAVE A COURT ORDER LAID AGAINST HIM.

YOUR RIGHTS THEREFORE ARE TO DEMAND WCC HAVE THE LIVESTOCK REMOVED, BEING UNLAWFULLY ENTERED, THERE IS NO PUBLIC LIABILITY, IT IS TIME THAT INSTEAD OF HAVING A GO AT THE PETITIONER'S, 2,500+ YOU SUPPORT THEM IN REGAINING THE COMMON LAND BACK.

MY SUPPORT IS CLEAR TO SEE

"Disturbance on site is typically restricted to pathways on areas of blown sand on Lower Terrace and at the southern end of Upper Terrace and the Scarp Slope. This localised disturbance is for the most part caused by walkers"

speaks volumes when it comes from an independent source

And what source would that be? Localised disturbance mostly caused by walkers.

A rubbish, claim, based on fantasy not facts, not tucker by any chance?

Another woman killed yesterday on a common by cattle. Try googling, "cattle, cows kill injure walkers etc"

Dozens and dozens

IT IS TRUE THAT EROSION CAN AND IN THIS MATTER IS DUE TO PEDESTRIAN TRAFFIC, HAVING SAID THAT, IT IS LAWFUL, WE ALL HAVE THE RIGHTS TO ACCESS THIS AND OTHER COMMON LANDS.

HOWEVER, I TRUST THAT YOU WILL CONSIDER THE OTHER, ACCESS TO THIS COMMON IS ALSO BY CYCLE AND HORSES, I WILL  OFFER MYSELF TO CHALLENGE WHEN I STATE THAT THE LATTER ARE UNLAWFUL, RURAL COMMON AND IS PEDESTRIAN, IT IS THEREFORE A PUBLIC HIGHWAY.

NOW CONSIDER ALSO, THE INTRODUCTION OF CATTLE, THESE WEIGH FROM 500LBS UPWARDS, HOW MUCH EROSION/DAMAGE WOULD YOU CONSIDER THEY WILL EFFECT WHAT IS ACKNOWLEDGED AS FRAGILE SOIL ON HARTLEBURY COMMON, IF PEDESTAIN TRAFFIC IS SEEN AS THE MAIN CULPRIT AT THE MOMENT, WHAT EFFECT IS THE INTRODUCTION OF CATTLE GOING TO CONTRBUTE TO FURTHER EROSION?

THIS COMMON LAND IS OPEN PUBLIC ACCESS, THE CATTLE ARE UNLAWFUL, YOU CHOOSE.

"that would have come from the management plan written by the worcestershire wildlife consultancy. Who even did site visits to have a look for themselves. Like all plans not written by those that implement the ideas suggested within.

Odd how many people in the conservation proffession note erosion by people, unlike you that denies it but then again you have the blinkers on and don't like the idea that not all of your complaints are not due to the councils activities.

thusly i wont be signing your petition."

Your so clever but cannot spell? Hmmmmmmmmm

I HAVE always said that this destruction is happening alongside climate change. The TWO put TOGETHER make for a very real disaster. If the level of erosion is caused by walkers, why has it recentley accelerated and where are these destructive masses of people? Your Liz Nether has stated that the common is UNDERUSED?

I don't know why I waste my time trying to reason with idiots like you. Your not worth it.

Good bye

#1434: Steve McCarron - pretending to be someone else again. Tut , tut.

Please forgive my dyslexia I work hard for it not to be an issue but sometimes I just can't help it, don't assume that because the spelling is out that people are not clever, Albert Einstein for example was a dyslexic so are you honestly going to tell me that because he could quite spell that he isn't clever.

The common as a whole might be underused given that it is a 90 hectares, but the spots in which you have been qouting as not having footpath erosion are quite clearly places that suffer from high public usage. You may not see masses of people but say one or two every 20 minutes and that will have an affect. Ask the warden without jumping in his face about how his work is illegal and they will tell you that its people that are causing the problem in the areas you've  pinpointed, given that I did and he was more than ammicable to explain it all.

Also in regard to Tony Barnett, if it is illegal for horse riders to go on why has this comments page dreamt up arguement that the new gates are a problem for inexperienced horse riders, surely if they are illegal then you should be happy they can't get in.

I also don't know who you think is pretending here or have you from what I can gather got the impression that im a member of the council or have some sort of employment from the council? Cause guess what I don't.

Who said we can't ride horses on the common? There are bridle paths.

If you read my reply I said you were clever.

Erosion is taking place on the least used areas.

Your right, I do not know who you are but you know who I am. I can say what I want and assume the worse if you make counter comments on this site, there are actors aplenty.

Your points of view are way out of kilter with the vast majority of public opinions.

One of our supporters Carol can vouch for my sanity, would you like to meet up and have a walk around the common.

Pleased to see your spelling is sorted out

'Erosion is taking place on the least used areas.'

Can you put photos on showing which areas (not close ups) please so they can be compared and we can see which bits of the common you are on about?

Done it all before, look at my photobucket link on the main page, rather meet you to show you, can't do better than that, can I?

The slogan on the main boards should be "The only way is down" as the common decays.

You have one picture of a patch of cut gorse and the rest look like pictures of paths and an area of small cut trees with a picture of some brash put down to stop people walking to protect the new growth underneath? Are those all the pictures?

I AM NOT ONE TO MAKE ANY REMARKS ABOUT A PERSONS APTITUDE, MY IN PUT INTO THIS PAGE IS BASED ON LAW, PARLIAMENTARY LEGISLATION TO WHICH I AM FAMIULAR, AND USE ON DAY TO DAY BASIS, I TOO CAN MISPELL WORDS, ANYONE CAN, BUT INTELEGENCE OF THE READER SHOULD BE ABLE TO FOLLOW THE LINE OF ARGUMENT, ENOUGH SAID!

NOW MR GUEST, THE STATUTE OF LIMITATIONS PROVIDES THAT IT IS UNLAWFUL TOO; LIGHT FIRES, TOO CAMP AND TO ENTER ONTO AND OVER COMMON LAND BY CYCLE ANY MOTOR PROPELLED VEHICLE AND TO EXERCISE, TRAIN OR TO RIDE HORSES ONTO COMMON LAND.

BY NOT, DEMANDING FROM WCC PROOF OF OWNERSHIP, THEN YOUR ARGUMENT IS A PERSONAL ONE, IT IS ONE THAT YOU YOURSELF BELIEVE IN, WHICH I CAN ASSURE YOU IS INCORRECT.

THE ACCEPTANCE THAT HORSS MAY ENTER HARTLEBURY COMMON IS HEARSAY, THE COURTS, AT SOME STAGE WILL BE INVITED TO JUDGE ON THIS AND OTHER MATTERS SHOULD;SOMEONE GET INJURED BY A HORSE WHEN THE INJURED SEEK DAMAGES.

THE COURTS WILL ALSO BE GUIDED TO SECTIONS 47-1 AND 47-2 OF THE REPEAL OF THE ENCLOSURE ACT, THIS IS IN RESPONSE TO YOUR MENTION OF THE GATES.

THE WARDEN? THIS IS A PERSON IMPOSED ON MEMBERS OF THE PUBLIC BY WCC, HE HAS NO AUTHORITY ON THIS COMMON, WHICH WILL ALSO BE EXPOSED IN ANY COURT, THE COUNCIL HAVE NO JURISDICYION ON HARTLEBURY COMMON.

YOU MAY OF COURSE ARGUE WITH MY KNOWLEDGE, IN A DEMOCRATIC SOCIETY IT IS YOUR RIGHTS, BUT SHOULD YOU GET INJURED BY "WALKING INTO ANY UNLAWFULLY PLACED IMPEDIMENT" OR FALL, SLIP ON ALTERED GROUND SURFACES, OR GET INJURED BY A HORSE OR CYCLE, I WILL CHALLENGE YOU TO CLAIM COMPENSATION FROM THE COUNCIL.

THEY ARE NOT INSURED, THEY HAVE NO PUBLIC LIABILITY IN PLACE.

THERE ARE NO, PATHS ON THE DEFINITIVE PLAN OF THE COMMON, HORSE RIDDING IS PROHIBITED ON COMMON LAND, ECCEPT ON METRPOLITON, BOROUGH, THAT IS OWNED BY THE LOCAL AUTHORITY AND IS REGISTERED AS COMMON LAND.

IT WOULD AND IS ADVISABLE BEFORE TAKING AIR AND EXERCISE WITH YOUR CHOSEN METHODS IF INVITED, TO EXAMINE THE INSURRANCE DOCUMENT HELD BY THE AUTHORITY, SOMEONE MAY NEED TO SEEK DAMAGES.

HI EMILY, IT IS OF COURSE YOUR DECISION HOW YOU EXERCISE YOUR DOG, BUT, ON THIS COMMON LAND THE CATTLE ARE UNLAWFUL, AND MAY I SAY SOMEWHAT DANGEROUS, THE CATTLE ARE ONLY INTERESTED IN YOUR DOG, THIS COMMON IS FOR SAFE UNIMPEDED ACCESS, THERE IS NO NEED UNLESS AS STATED YOU WISH TO GO ABOUT BUSINESS AS YOU SEE FIT.

Cattle do not have to have calves. Whether your dog is on or off a lead will make NO difference if they decide to go for you and your dog.
