I believe when loving, willing, stable family members are available, the placement should be made to the family first and only placed into a stranger foster home after all potential family members have been vetted and found unable to take the responsibility of the child's welfare. My opinion is not an indictment of a foster care system, but rather questioning the specifics in this case. A biological mother who chooses to use illicit drugs only 4 days prior to the birth of her baby is not capable of making rational decisions for herself, let alone decisions that are in the best interest of the child. And a father who allows this behavior is complicit in this crime against the baby. They should have no say in the matter. The reasoning for this decision of stranger placement is flawed. These parents are long-term illicit drug users and are homeless. Their instability is factual. Long-term drug users are not "cured" overnight. They will need months of inpatient treatment and years of aftercare. Statistics of their successful abstinence from drug use are not in their favor. Most long-term addicts take years of treatment, aftercare and many relapses before healing. With devastating statistics such as these, why not place the child with a nurturing family member who would give the child the best start in life? Furthermore, even if the parents never become stable enough to assume responsibility for the child, her sister can be a stabilizing influence throughout her life. I would hope the court would reconsider what is truly best for the baby and release her to the custody of her sister and support of a loving extended family. To do less would be a travesty and misuse of judicial authority.
